1. The vehicle will be destined to transport persons only, without self-profits, and respecting the capacity of it. It will be driven by the solicitant only and it cannot be subleased, given to others or used in other ways without the written consent given by CAMPANARIO RENTACAR The vehicle cannot be taken outside Argentina without the corresponding additional permission.
2. In any case and under any circumstances the solicitant can put himself the title of representative, agent or chief executive of CAMPANARIO RENTACAR
3. The location duration is deduced from the respective dates chosen, and the automatic extension cannot be done under any circumstance. The exceeded period of the rented vehicle will be considered with a mere tolerance of ELEPHANT S.R.L, which can pick the vehicle up in any moment, and in its most convenient way without any oppositions by the solicitant. The exceeded period will be paid by the customer according to the current rates given by CAMPANARIO RENTACAR
4. The solicitant will be the holder of the vehicle assuming all the civil and penal responsibilities this contract implies, during the rental period and until its return to CAMPANARIO RENTACAR
5. When the contract period expires, the solicitant should return the hired vehicle immediately in the same conditions that was received and at CAMPANARIO RENTACAR address.
6. The solicitant is responsible, during the hire period, of the material and/or legal care of the vehicle and it is its responsibility to compensate to CAMPANARIO RENTACAR or to its insurance company for the following damages: A) Any damage to the property caused to or by the hired vehicle. B) Any damage done to persons and/or goods transported in the hired vehicle. C) Any damage to third persons. D) Any fine due to violation against rules and/or city, province, federal and/or state traffic ordinances. E) Lost profits of CAMPANARIO RENTACAR resulting from the physical and/or juridical impossibility of the vehicle affectation for the hire service. F) Any moral damage caused by the solicitant to third persons.
7. The solicitant will pay to ELEPHANT S.R.L cash and at its address for the rent and other charges, according to the basis and rates given in this agreement for the agreed period, thus any exceeded period of the return date to ELEPHANT S.R.L and its reception with entire satisfaction. The amount to be paid by the solicitant deduced from the settlement should be completely paid when the hired vehicle is returned.
8. The solicitant is responsible of the additional cost of the insurance for damages caused to or by the hired vehicle, whatever would be the cause of the damage, crash, turnover,
tumble, fire, theft, etc. The payment does not exclude the solicitant to pay the costs of reparation or reposition of the vehicle in case it is the solicitant´s responsibility.
In case of accident the solicitant should call immediately to ELEPHANT S.R.L and it cannot exceed 24 hours from the accident to the call.
9. It is completely forbidden to drive the hired vehicle in the following conditions: A) Under the influence of alcohol, medicine or drugs. B) Without the current driving license given by competent authorities and accepted by argentine authorities. C) Violating the respective traffic rules and ordinances.
10. The hired vehicle cannot be used in: A) Different uses to the ones established in this contract, or the transport of passengers or other type of public service. B) Transport of charge, heavy or dangerous packages. C) Dangerous or illicit actions. D) Trailers of any type. E) Different places to the ones established in this contract. F) Car or speed contests, etc., or any kind of contest. G) Routes or roads that were not declared as open to traffic by competent authorities.
11. The solicitant has the compromise to accomplish all the above mentioned conditions and knows that the breach of any of them allows CAMPANARIO RENTACAR to finish the hire contract without any requirement and/or previous intimation; resulting in charge of the solicitant all responsibility assumed with the sign of it. The violation to any clause of this contract means the commission of penal crimes indicated to CAMPANARIO RENTACAR
12. The amount indicated in this contract will be deposited to CAMPANARIO RENTACAR as guarantee of accomplishment of it, being CAMPANARIO RENTACAR able to use it partial or totally in order to pay any of the hire emergent obligations without notice or to apply to any formality or requirement.
13. CAMPANARIO RENTACAR has the right of asking the solicitant for a guarantor, main payer, responsible for the paying of every emergent obligation of the hire contract in charge of the solicitant
14. CAMPANARIO RENTACAR is not responsible for the items forgotten or lost inside the vehicle.
15. The solicitant must pay the stamp taxes this contract would require.
16. Both parts agree that in case of any difference and/or claim derived from the present contract, it will be sent to the court of San Carlos de Bariloche, giving up any other regional code or jurisdiction that could correspond.
PENAL CLAUSE: THE DELAY OR UNFULFILLMENT OF THE OBLIGATIONS GENERATED IN THE PRESENT CONTRACT WILL GENERATE AN INDEMNITY IN FAVOUR OF THE CREDITOR OF 3.5% MONTHLY OVER THE OWED MONEY, WITHOUT PREJUDICE OF THE MAIN OBLIGATION ACCOMLISHMENT.
1° El solicitante destinará el automóvil al transporte de personas en forma exclusiva, sin fines de lucro y dentro de la capacidad normal del vehículo. Deberá manejarlo personalmente y no podrá subarrendarlo, cederlo, o disponer de él en alguna forma sin el consentimiento expreso manifestado por escrito por ELEPHANT S.R.L. Tampoco podrá conducir el vehículo fuera del territorio de la República Argentina sin el correspondiente permiso adicional.
2° En ningún caso y bajo ninguna circunstancia podrá el solicitante arrogarse el carácter de representante, agente o mandatario de ELEPHANT S.R.L.
3° La duración de la locación surge del plazo establecido en el anverso en el casillero respectivo, no pudiendo el solicitante alegar la tácita reconducción o renovación automática de la locación por ningún motivo. El plazo en exceso durante el cual el solicitante retuviere el vehículo arrendado será considerado una mera tolerancia de ELEPHANT S.R.L., quien podrá recuperarlo en cualquier momento y en la forma que estime más conveniente a sus intereses, sin que el solicitante pueda oponer excepción alguna. El plazo en exceso del término convenido será abonado por el solicitante de conformidad con las tarifas en vigencia para el alquiler de los vehículos de ELEPHANT S.R.L.
4° El solicitante se constituye en depositario y custodio del vehículo asumiendo todas las responsabilidades civiles y penales que tal condición implica, durante el término de la locación y hasta tanto proceda a su devolución a ELEPHANT S.R.L.
5° Vencido el plazo de locación, el solicitante debe devolver el automóvil arrendado en forma inmediata en el mismo estado en que lo recibió y en el domicilio de ELEPHANT S.R.L.
6° El solicitante es enteramente responsable mientras permanezca en la tenencia del automóvil, de la guardia material y/o jurídica del mismo, debiendo resarcir a ELEPHANT S.R.L. o a su compañía de seguros los siguientes perjuicios: A) Por cualquier daño a la propiedad causado al o por el vehículo arrendado. B) Por los daños causados a personas y/o bienes transportados en el vehículo arrendado. C) Por los daños a terceras personas. D) Por las sanciones a violaciones que cometa o le imputen haber cometido contra los reglamentos y/u ordenanzas de tránsito municipales, provinciales, federales y/o estatales. E) Por el lucro cesante de ELEPHANT S.R.L. resultante de la imposibilidad física y/o jurídica de afectación del vehículo al servicio de alquiler. F) Por el daño moral que la culpa y/o negligencia del solicitante causare a terceras personas.
7° El solicitante abonará a ELEPHANT S.R.L. al contado y en el domicilio de este, el alquiler y demás cargos, según las bases y las tarifas consignadas en el adverso de esta solicitud por el término pactado, además de cualquier plazo en exceso transcurrido hasta el momento de la devolución a ELEPHANT S.R.L. y su recepción a entera satisfacción. El monto adeudado por el solicitante resultante de la liquidación practicada en este instrumento debe ser abonado íntegramente en el momento de la devolución del vehículo arrendado.
8° El solicitante toma a su cargo el costo adicional por el seguro contra daños causado al o por el vehículo objeto de la locación cualquiera fuera la índole del hecho, choque, vuelco, despeñamiento, incendio, robo, etc. Este pago no exime al solicitante de hacer frente a los gastos de reparación o reposición del vehículo en el caso de hechos imputables a su culpa y/o negligencia. En caso de cualquier accidente deberé dar aviso inmediato a ELEPHANT S.R.L., no pudiendo exceder un lapso de 24 horas de ocurrido el mismo.
9° Le estará absolutamente prohibido al solicitante conductor, conducir el automóvil arrendado en las siguientes condiciones: A) En estado de ebriedad o bajo los efectos de calmantes, tranquilizantes o narcóticos. B) Sin licencia válida para conducir, expedida por las autoridades competentes y aceptada por las autoridades Argentinas. C) En violación de los reglamentos y ordenanzas de tránsito respectivas. 10° El solicitante no podrá dedicar el automóvil arrendado a: A) Usos distintos a los estipulados en este contratos, ni al transporte de pasajeros u otro tipo de servicio público. B) Al transporte de carga o bultos pesados o peligrosos. C) A labores peligrosas o ilícitas. D) Operaciones de remolque de cualquier clase. E) A conducirlo en lugares distintos a los estipulados en el contrato. F) A participar con este en pruebas automovilísticas, de velocidad, de regularidad, etc. o en certámenes de cualquier tipo. G) No podrá tampoco conducir el automóvil por rutas o caminos que no hayan sido declarados como expeditos al tránsito por autoridades competentes.
11° El solicitante se compromete a dar cumplimiento a todas y a cada una de estas condiciones y acuerda que el incumplimiento de cualquiera de ellas dará lugar a ELEPHANT S.R.L. a declarar rescindida la locación sin necesidad de requerimiento y/o intimación previa alguna de parte de ésta quedando a cargo del solicitante todas y cada una de las obligaciones asumidas con la firma del presente. Las contravenciones a las distintas cláusulas de este contrato, configuran para el solicitante la consumación de los delitos penales que las circunstancias indiquen a ELEPHANT S.R.L.
12° El solicitante depositará en poder de ELEPHANT S.R.L. la suma indicada en esta solicitud, en garantía del cumplimiento de la misma, quedando facultado ELEPHANT S.R.L. a disponer del mismo en forma total o parcial a fin de cubrir cualquiera de las obligaciones emergentes de la locación sin necesidad de aviso previo, ni de cumplir con cualquier otro tipo de formalidad o requerimiento.
13° ELEPHANT S.R.L. se reserva el derecho de pedir al solicitante la presentación de un fiador, liso, llano y principal pagador que se obligara por todas y cada una de las obligaciones emergentes de la locación a cargo del solicitante.
14° Queda establecido que ELEPHANT S.R.L. no se responsabilizará por la pérdida de cualquier objeto de cualquier naturaleza ubicado o dejado en el automóvil arrendado.
15° El solicitante conviene pagar el impuesto de sellos que pudiera gravar la presente solicitud.
16° Las partes convienen que para toda diferencia y/o reclamo derivado de la presente se someterán a la jurisdicción de los tribunales ordinarios de San Carlos de Bariloche renunciando a cualquier otro fuero o jurisdicción que pudiere corresponderles.
CLAUSULA PENAL: EL RETARDO O INCUMPLIMIENTO DE LAS OBLIGACIONES GENERADAS EN EL PRESENTE, GENERARÁ UNA INDEMNIZACIÓN A FAVOR DEL ACREEDOR DE 3.5% MENSUAL SOBRE EL MONTO ADEUDADO, SIN PERJUICIO DEL CUMPLIMIENTO DE LA OBLIGACIÓN PRINCIPAL.
